Client Service Terms

1. Agreement and Scope
These Client Service Terms apply when you engage Creativlix Technologies (“Creativlix”, “we”, “us”) for a project or service. Together with your quote and the information in your client space, they form the agreement between us. They complement our Terms & Conditions and Privacy Policy.
The scope of each engagement is defined by the written quote and the deliverables it lists. Anything not listed in the quote is out of scope and can be added through a separate quote.
2. Quotes and Acceptance
Quotes are valid until the date stated on them. You accept a quote and these terms electronically, through the acceptance button in your client space. We record the date and the version of the terms you accepted, and this electronic acceptance is binding, as permitted by Ontario's Electronic Commerce Act, 2000.
3. Payment
- Unless the quote states otherwise, projects start with a 50% deposit and the remaining 50% is due at delivery, before final handover or launch.
- The deposit is non-refundable once work has begun: it covers the work already performed.
- All prices are in Canadian dollars unless stated otherwise.
- If an invoice remains unpaid past its due date, we may pause work until payment is received.
4. Revisions
Every project includes three free revision rounds after acceptance of the quote.
- A revision round is one consolidated list of change requests sent to us in a single message. Grouping your feedback keeps the project fast and gives you the most value from each round.
- Revisions are adjustments to what the quote covers: text, colors, images, layout refinements, and similar changes to existing deliverables.
- New pages, new features, new sections, or new services are not revisions. They are scope changes and are quoted separately before any work begins.
- Additional revision rounds beyond the three included are possible: we quote them before starting, so there are never surprise charges.
5. Bug-Fix Warranty
For 30 days after delivery, we fix technical defects in our work free of charge, and these fixes do not count against your revision rounds. This warranty covers things that are broken: layout errors, broken links, form failures caused by our code. It does not cover new requests, changes made by you or a third party after delivery, or issues caused by third-party services (hosting, browsers, external APIs) changing their behavior.
6. Client Responsibilities and Project Dormancy
- You provide the content, credentials, and approvals the project needs, and you respond to feedback requests within 7 business days so the project keeps moving.
- If a project stays inactive for 30 days because we are waiting on you, we may place it on hold and archive it. The deposit remains non-refundable.
- A paused project can be resumed: depending on how much rework the restart requires, resuming may be subject to a quote.
7. Delivery and Ownership
- Delivery means the deliverables are handed over to you or published on your own hosting, as defined in the quote.
- Intellectual property in the deliverables transfers to you upon full payment. Until then, the work remains ours.
- We may show the delivered work in our portfolio and communications unless you ask us not to in writing.
- Third-party components (fonts, stock images, plugins, libraries) remain governed by their own licenses.
8. Hosting and Third-Party Services
You own your hosting, domain, and third-party accounts (analytics, chat, email, payment providers, and similar). Creativlix does not host client websites: we deploy to infrastructure you own or control. Fees charged by third parties are your responsibility, and we are not liable for their outages, pricing changes, or decisions.
9. AI-Assisted Work
Creativlix uses AI tools as part of its workflows, notably for development, design, and AI implementation work. We review and validate AI-assisted output before delivery, and you remain responsible for final approval of business-critical content (legal wording, pricing, claims about your products). We cannot guarantee the behavior, availability, or pricing of third-party AI models and services.
10. Service-Specific Terms
Web & App Development
Deliverables, supported browsers, and any post-launch tasks are defined in the quote. The revision and warranty policies above apply.
Graphic Design
Designs are produced with professional design tools and delivered in the formats stated in the quote, source files included. Licenses for third-party assets (fonts, stock images, templates) remain governed by their providers, and their costs are your responsibility unless the quote includes them.
IT Support and System Administration
Response times, coverage hours, and monitoring commitments apply only when defined in a support plan or quote. Without a plan, support is provided on a best-effort, quoted basis.
Training and Workshops
Sessions can be rescheduled free of charge with at least 48 hours notice. Cancellations with less notice may be charged, since the time was reserved for you.
AI Implementation
Usage costs of AI providers (API fees, subscriptions, tokens) are your responsibility and are billed by those providers directly, unless the quote states otherwise.
11. Maintenance and Ongoing Support
Maintenance, content updates, and ongoing support after delivery are not included unless covered by a separate agreement or support plan. We are always happy to quote one.
12. Warranties and Limitation of Liability
We commit to professional, workmanlike delivery. We do not guarantee business outcomes such as search rankings, traffic, or revenue. To the maximum extent permitted by law, our total liability for an engagement is limited to the amounts you paid us for that engagement, and we are not liable for indirect or consequential damages.
13. Termination
Either party may end an engagement with written notice. You pay for the work completed up to that date, the deposit remains non-refundable, and we hand over the work in its current state once the account is settled.
14. Governing Law
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein.
